1. About these Terms

Welcome to VOSSILO™. These Terms of Service (the “Terms”) govern your access to and use of vossilo.com, including the purchase of products through our online store (collectively, the “Services”).

The terms “VOSSILO”, “we”, “us” and “our” refer to the legal seller operating under the VOSSILO™ trading name. The seller’s legally required identification details and geographical address are provided in our Legal Notice and, where applicable, in the information supplied during the purchase process.

Our store is hosted by Shopify, which provides the ecommerce platform that enables us to offer the Services. Purchases made through the store are made directly from VOSSILO, not from Shopify.

By accessing the Services or placing an order, you agree to these Terms and to the policies incorporated into them, including our Privacy Policy, Shipping Policy and Return & Refund Policy. If you do not agree, please do not use the Services.

Nothing in these Terms limits or excludes any mandatory rights you have under applicable consumer law.

2. Eligibility and account information

You must have the legal capacity required in your country of residence to enter into a purchase contract. If you are under the age of majority, you may use the Services only with the involvement and authorisation of a parent or legal guardian.

You agree to provide accurate, current and complete information when placing an order or creating an account. You are responsible for keeping your account credentials confidential and for activity carried out through your account, except where such activity results from circumstances attributable to us.

You must notify us promptly at vossilo@outlook.com if you suspect unauthorised access to your account.

3. Product information

We take reasonable care to ensure that product descriptions, images, dimensions, specifications, availability and prices are accurate. However, colours and appearance may vary slightly depending on your screen, lighting and device settings. Minor differences that do not affect the product’s essential characteristics or conformity may occur.

We may update product information, correct genuine errors or discontinue products at any time. Any correction affecting an order already placed will be handled in accordance with applicable law, and we will contact you where necessary.

Product information on the website is provided for general wellness and informational purposes only. Unless expressly stated otherwise, our products are not medical devices and are not intended to diagnose, treat, cure or prevent any disease or medical condition. If you have a medical condition, are pregnant, have an implanted medical device, have a scalp or skin condition, or have concerns about whether a product is suitable for you, seek advice from an appropriately qualified healthcare professional before use.

Always follow the instructions and safety information supplied with the product.

4. Orders and formation of the contract

Displaying a product on our website is an invitation to place an order and does not, by itself, constitute acceptance of an order.

After you place an order, you will receive an electronic acknowledgement. The purchase contract is formed when we send you confirmation that the order has been accepted or dispatched, depending on the wording of the confirmation you receive. Payment authorisation or an automated acknowledgement does not necessarily mean that the order has been accepted.

We may refuse or cancel an order before acceptance where there is a legitimate reason, including:

  • the product is unavailable;

  • payment cannot be authorised;

  • the shipping address is incomplete, invalid or outside the available delivery area;

  • there is an obvious and recognisable pricing or product-information error;

  • we reasonably suspect fraud, unauthorised activity or purchase for commercial resale; or

  • legal or regulatory restrictions prevent us from fulfilling the order.

If payment has already been taken for an order that we do not accept, we will refund the amount paid without undue delay using the original payment method.

Please review your order carefully before submitting it. Requests to amend or cancel an order should be sent as soon as possible to vossilo@outlook.com. We cannot guarantee that an order can be changed after processing has begun. Your statutory cancellation and return rights remain unaffected.

5. Prices, taxes and payment

The price payable is the price displayed at checkout when you place your order. Before you confirm the purchase, we will show the total price, including applicable taxes and any delivery charges that can reasonably be calculated in advance.

Where an order is delivered internationally, customs duties, import taxes or handling charges may apply. If these charges are not collected at checkout, they may be payable by the recipient. Any such arrangement will be disclosed before purchase where required by law.

Promotions, discount codes and special offers may be subject to separate conditions, availability periods and eligibility requirements. Unless stated otherwise, promotions cannot be combined. A promotion does not affect your statutory rights.

You confirm that you are authorised to use the payment method supplied. Payment processing may be provided by independent payment service providers and is subject to their security and verification procedures.

6. Shipping, delivery and risk

Delivery dates are estimates unless we expressly agree to a specific guaranteed date. We will take reasonable steps to deliver within the stated timeframe and will notify you of material delays where possible. Your rights in the event of late or failed delivery are not affected by this clause.

For consumers, risk of loss or damage passes to you when you, or a third party nominated by you other than the carrier, physically receives the goods, except where you independently commissioned a carrier that was not offered by us.

You are responsible for checking that the delivery information supplied is complete and accurate. If you notice an error, contact us immediately. We will make reasonable efforts to assist, but we cannot guarantee changes after dispatch. Nothing in this section excludes liability where delivery failure is attributable to us or to a carrier engaged by us.

7. Returns, cancellation and refunds

Our voluntary 30-day return policy, the European Union’s statutory 14-day right of withdrawal where applicable, return conditions and refund process are described in our Return & Refund Policy: https://vossilo.com/policies/refund-policy.

The voluntary return policy is separate from, and does not replace, your statutory rights concerning defective or non-conforming goods.

8. Product conformity and legal guarantees

Products must conform to the contract and to the description and reasonable expectations created by the information provided before purchase. If a product is defective, damaged, incorrect or otherwise non-conforming, contact us at vossilo@outlook.com with your order number and a description of the issue. We may reasonably request photographs, video or other information needed to assess the issue, provided this does not unreasonably obstruct your rights.

Where mandatory consumer law applies, you may be entitled to remedies such as repair, replacement, a price reduction or termination of the contract and a refund, subject to the applicable legal conditions. Any commercial guarantee we may offer is additional to these rights and does not restrict them.

9. Acceptable use

You may use the Services only for lawful, personal and non-commercial purposes. You must not:

  • use the Services in violation of applicable law or the rights of another person;

  • submit false, fraudulent or misleading information;

  • interfere with the security, availability or proper operation of the Services;

  • introduce malware, harmful code or content;

  • attempt to gain unauthorised access to accounts, systems or data;

  • use automated methods to extract content or data in a way that places an unreasonable burden on the Services or violates applicable law; or

  • use the Services to send spam, harass others or impersonate another person or organisation.

We may restrict or suspend access where reasonably necessary to protect the Services, users or third parties, to investigate suspected misuse, or to comply with law. Where appropriate and legally required, we will provide notice and an opportunity to remedy the issue.

10. Intellectual property

Unless otherwise stated, the website and its content—including the VOSSILO™ name, logos, text, graphics, photographs, videos, layout and design—are owned by or licensed to VOSSILO and are protected by applicable intellectual property laws.

You may access and use the Services for personal, non-commercial purposes. You may not reproduce, distribute, modify, publish, sell, exploit or create derivative works from protected content without prior written permission, except where permitted by law.

Third-party names, logos and trademarks belong to their respective owners. Shopify is a trademark of Shopify Inc. or its affiliates.

11. Reviews, submissions and feedback

If you submit a review, photograph, suggestion or other content, you confirm that you have the right to submit it and that it is truthful, lawful and does not infringe another person’s rights.

You grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce, adapt and display that content only as reasonably necessary to operate, improve and promote VOSSILO and the Services, subject to applicable privacy and consumer-protection law. This licence does not transfer ownership of your content to us.

If any incentive was offered for a review, this must be disclosed. We may moderate or remove content that is unlawful, abusive, misleading, irrelevant, infringing or otherwise violates these Terms. We do not promise that every submission will be published.

12. Third-party services and links

The Services may rely on third parties such as Shopify, payment processors, logistics providers, analytics providers, customer-support tools and review platforms. Their processing of personal data is addressed in our Privacy Policy.

The website may contain links to third-party websites. We are not responsible for third-party content or services that are outside our control. You should review the relevant third party’s terms and privacy information before using its services. This does not limit any responsibility we may have for providers acting on our behalf.

13. Privacy and cookies

Our collection and use of personal data are described in our Privacy Policy: https://vossilo.com/policies/privacy-policy. Information about cookies and similar technologies, including available choices, is provided through our cookie notice and consent settings.

Because our store is hosted by Shopify, certain personal data is processed by Shopify and by service providers involved in operating the store, processing payments, preventing fraud, fulfilling orders and providing support. Further details are set out in the Privacy Policy.

14. Liability

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or liability arising under mandatory consumer-protection law.

We are responsible for loss or damage that is a foreseeable result of our breach of these Terms or failure to exercise reasonable care and skill. We are not responsible for loss that was not reasonably foreseeable when the contract was formed, or for business losses suffered by a consumer using the product for personal purposes.

To the extent permitted by law, we are not liable for failure or delay caused by events outside our reasonable control. If such an event materially affects an order, we will take reasonable steps to minimise the impact and will inform you where appropriate. Your mandatory rights, including rights relating to delivery and refunds, remain unaffected.

15. Indemnity for unlawful business use

If you use the Services for commercial purposes or in a manner that is unlawful or materially breaches these Terms, you may be responsible for reasonably foreseeable losses directly caused by that conduct, to the extent permitted by law. This section does not apply in a way that would unfairly shift our responsibilities to a consumer or restrict mandatory consumer rights.

16. Termination

You may stop using the Services at any time. We may suspend or terminate access where you materially breach these Terms, engage in fraud or unlawful conduct, threaten the security or operation of the Services, or where suspension is required by law.

Termination does not affect rights and obligations that arose before termination, including payment obligations, intellectual property rights, liability provisions and dispute-resolution rights that by their nature continue afterward.

17. Governing law and disputes

These Terms and purchase contracts are governed by the laws of Spain, without depriving a consumer residing in another country of any mandatory protection provided by the law of that consumer’s habitual residence where applicable.

If you have a complaint, please contact us first at vossilo@outlook.com so that we can try to resolve it directly.

Any dispute may be brought before the courts having jurisdiction under applicable law. If you are a consumer, nothing in these Terms requires you to bring proceedings exclusively in a court other than one available to you under mandatory consumer law, including the courts of your place of residence where applicable.

18. Severability and no waiver

If any provision of these Terms is found to be invalid or unenforceable, it will be limited or removed only to the minimum extent necessary. The remaining provisions will continue in effect.

If we do not immediately enforce a provision, this does not mean that we waive our right to enforce it later.

19. Changes to these Terms

We may update these Terms to reflect changes to the Services, our business practices or legal requirements. The current version and its update date will be published on this page.

Changes will not retroactively alter an order already accepted unless required by law or expressly agreed with you. Where required, we will provide reasonable notice of material changes before they take effect.
